1. Introduction

Welcome to VibeFunnel. These Terms and Conditions govern your use of our platform and services. By accessing or using VibeFunnel, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Definitions

"Platform" refers to the VibeFunnel website and services.
"User" refers to the individual accessing or using the Platform.
"Content" refers to any information, data, text, graphics, images, or other materials uploaded, downloaded, or appearing on the Platform.

3. Account Registration

To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Pricing and Payment

All fees are due in full before access is granted to the Platform. Payment terms and pricing are subject to change at our discretion.

Current pricing information and trial period availability can always be found on our pricing pages. Trial periods may be offered at our discretion and are subject to the terms and conditions applicable to such trials.

All payments must be made in full before access to paid features is granted.

5. Termination

You may terminate your subscription at any time by providing written notice. Termination does not entitle you to any refund of fees paid.

We reserve the right to suspend or terminate your access to the Platform, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms and Conditions.

6. No Refund Policy

ALL SALES ARE FINAL. We do not offer refunds, credits, or exchanges under any circumstances. Once payment has been made and access granted, no refunds will be issued regardless of usage, satisfaction with the Platform, technical issues, or any other reason whatsoever.

While we maintain a strict no refund policy, trial periods may be available to evaluate the Platform before purchase. Trial period availability, duration, and terms are determined at our sole discretion and may change without notice. Please check our pricing pages for current trial offerings.

7. User Obligations

You agree not to use the Platform to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any material that is unlawful, harmful, threatening, abusive, or otherwise objectionable
  • Impersonate any person or entity
  • Interfere with or disrupt the Platform or servers
  • Attempt to gain unauthorized access to any portion of the Platform

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by VibeFunnel and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9. Service Provision "As Is" and Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VibeFunnel makes no representations or warranties of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

NO LIABILITY FOR DATA LOSS OR CORRUPTION: VibeFunnel shall have no liability whatsoever for any loss, corruption, or damage to your data, including but not limited to user content, campaign data, analytics information, or any other information stored on or transmitted through the Platform. You are solely responsible for backing up and protecting your data.

COMPREHENSIVE LIMITATION OF LIABILITY: In no event shall VibeFunnel, its directors, officers, employees, partners, agents, suppliers, affiliates, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, revenue, or business opportunities
  • Loss or corruption of data or information
  • System downtime or service interruptions
  • Personal injury or property damage
  • Third-party claims or actions
  • Any other losses or damages of any kind

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if VibeFunnel has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

MAXIMUM LIABILITY CAP: In any event, VibeFunnel's total liability to you for all damages, losses, and causes of action shall not exceed the amount you paid to VibeFunnel in the twelve (12) months preceding the event giving rise to liability.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Spain.
